選擇了做亞馬遜,寄生在第三方平臺(tái)上經(jīng)營,就注定你不可能一直高枕無憂,隨時(shí)都可能有戰(zhàn)情,比如,這個(gè)春節(jié),就讓一些賣家過得很郁悶。
原本賣的好好的產(chǎn)品,或跟賣或自建,經(jīng)過多方面評(píng)估加經(jīng)驗(yàn)判定不侵權(quán)的命名為Generic的產(chǎn)品,突然之間收到平臺(tái)的郵件通知,輕則產(chǎn)品被移除,更多的卻是直接被移除銷售權(quán)限。
事件首先是從亞馬遜加拿大站點(diǎn)爆發(fā)的,緊接著就蔓延到美國站,很多賣家都覺得躺槍了,可是也無計(jì)可施,只能誠恐誠惶的寫申訴郵件,但收到的回復(fù)多是系統(tǒng)自動(dòng)回復(fù)的郵件模板。
下面是某賣家收到的被移除銷售權(quán)限的通知:
Hello,
You currently may not sell on Amazon.ca because you are offering items that may infringe intellectual property rights or may be inauthentic. Examples of these items are at the end of this email.
Funds will not be transferred to you but will stay in your account while we work with you to address this issue. If you have any open orders, please ship them.
You can see your balance and settlement information in the Payments section of Seller Central. If you have questions about those, please write to payments-investigate@amazon.ca.
To sell on Amazon.ca again, please send the following information to pq-review@amazon.ca:
-- Copies of invoices, receipts, contracts, delivery orders, or authorization letters from your supplier issued in the last 90 days. The quantity of items shown should match your inventory.
-- If you are not the brand owner, provide an authorization letter and a complete set of documentation, including authorization letters, to prove a valid supply chain.
-- If you are the brand owner, provide a copy of the brand registration certificate, and business license or personal identity card.
-- Any additional details you would like us to know.
You can send .pdf, .jpg, .png, or .gif files. These documents must be authentic and unaltered. You may remove pricing information, but the rest of the document must be visible. We will maintain the confidentiality of your supplier contact information.
We will review your information and decide if you may sell on Amazon.ca again. If you do not send the required information within 17 days, we may not allow you to sell on Amazon.ca.

在通知的結(jié)尾處,亞馬遜舉例了侵權(quán)的商品,而這些產(chǎn)品被列舉出來的原因,都是因?yàn)楫a(chǎn)品發(fā)布時(shí)在Brand處填寫了Generic。
我們知道在發(fā)布產(chǎn)品時(shí),Brand Name是一個(gè)必填項(xiàng),Amazon也規(guī)定對(duì)于沒有品牌的產(chǎn)品,一律填寫Generic。所以很多賣家這么做了,但如今卻遭到因?yàn)槭褂肎eneric而成了侵權(quán)產(chǎn)品,著實(shí)讓人很無語。
我們知道Generic在英文中的本意是“通用的、不注冊(cè)的、非專利的”意思,但如果去美國商標(biāo)局網(wǎng)站上查詢,你同樣可以發(fā)現(xiàn)Generic又是一個(gè)被注冊(cè)的商標(biāo)。當(dāng)一個(gè)原本具有通用意思的詞語成為商標(biāo),如果商標(biāo)持有人去投訴,我們不知道亞馬遜會(huì)對(duì)此做出如何的判定,但問題畢竟已經(jīng)爆發(fā)出來了。
帶著這個(gè)問題,老魏我在Amazon美國站首頁用Generic來搜索,截止到目前為止,依然可以獲得170多萬個(gè)搜索結(jié)果,可見如果一刀切全部下架和移除賬號(hào)銷售權(quán)限,肯定波及到太多的賬號(hào)的。
針對(duì)當(dāng)前的這種情況,我估計(jì)亞馬遜應(yīng)該會(huì)和其他商標(biāo)做區(qū)別對(duì)待的,畢竟之所有有這么多賣家如此發(fā)布,也是系統(tǒng)在發(fā)布時(shí)的提醒導(dǎo)致的。但不管怎么說,如果賬號(hào)已經(jīng)遭遇了這樣的情況,申訴還是必須的,那么具體該怎么申訴呢?首先一定要誠懇的表明自己是一個(gè)誠信的賣家,沒有有意侵權(quán)別人的意思,同時(shí),有相應(yīng)的采購單據(jù)發(fā)票的,也一定要積極提供,能多全面就多全面,在此之外,還要在郵件中著重強(qiáng)調(diào),之所以使用Generic填寫在Brand Name處,是因?yàn)橄到y(tǒng)的提醒,是按照亞馬遜的規(guī)章要求操作的,最后還要懇請(qǐng)亞馬遜能夠給一次機(jī)會(huì),自己將立即對(duì)店鋪?zhàn)龀稣牡鹊取?/div>
對(duì)于當(dāng)前有Generic產(chǎn)品在線但尚未收到通知的賣家,我建議最好是能夠?qū)isting進(jìn)行編輯或者刪除,能夠編輯品牌名稱的,果斷編輯修改,不能夠編輯品牌名稱的,果斷刪除,也許有些賣家會(huì)說,我還有不少產(chǎn)品在庫存,對(duì)于這個(gè)狀況,我只能說,你自己要對(duì)比一下,是匆忙的銷售一些產(chǎn)品然后導(dǎo)致賬號(hào)死掉劃算,還是損失一點(diǎn)庫存,增加一點(diǎn)成本,保護(hù)賬號(hào)安全劃算。
注意我這里說的刪除(Delete),而不是關(guān)閉(Close)。刪除意味著這條Listing在亞馬遜數(shù)據(jù)庫中消失,而關(guān)閉意味著該Listing的數(shù)據(jù)依然記錄在亞馬遜中的數(shù)據(jù)庫中,只是在前臺(tái)不可見,之前曾經(jīng)發(fā)生過不少賣家因?yàn)榍謾?quán)產(chǎn)品僅僅Closed掉,很長時(shí)間后,自己已經(jīng)忘記了的情況下卻導(dǎo)致賬號(hào)突然受限的情況。
不管怎么說,依托于第三方平臺(tái)進(jìn)行銷售,就意味著我們需要不停的面對(duì)新情況解決新問題的過程,當(dāng)前我們尚無法判定此事件的最終處理結(jié)果,但不可否認(rèn)的是,這次事件再次給賣家敲響警鐘,在亞馬遜平臺(tái)上,沒有商標(biāo)的裸泳不行了,打算長期做下去的賣家,也確實(shí)需要快速行動(dòng)起來,注冊(cè)自己的商標(biāo),做好應(yīng)有的保護(hù),在安全的基礎(chǔ)上,精耕細(xì)作才是上策。
